Once you are happy with the bespoke quote that you have received by email, please click the blue button at the bottom which will take you to a simple form to be completed online. You will receive a Welcome email from us which will outline what we require next.
Evolve Law are obliged to check your identity and the source of the funds which you intend to use to purchase the property to satisfy anti-money laundering legislation before moving forwards with the transaction.
Meanwhile you will have formally applied for the mortgage and once an offer has been sent out by the lender, we will approve the terms and sent a Mortgage Report to you for approval.
We will receive a contract package from the seller’s lawyer that contains vital information about the property and will begin to raise enquiries which is where we seek clarification on legal points.
Once we are in possession of the contract package, we will request monies from you in order to apply for the searches. These are documents, if required by your mortgage lender, that are issued by the relevant council and private providers and they inform us about water & drainage matters in addition to environmental issues that we should be aware of. The searches usually take a few weeks to be sent to us but once we have received them, we will send a Search Report to you for approval. Should your lender not require these, we will take out an indemnity policy on your behalf.
Once we are satisfied with the responses from the other side, we will send you a Report on Title which will inform you about the purchase and all relevant information.
Upon confirmation that all parties are ready to proceed and we have completed a final file audit, we will ask you to sign your contract, TR1 (transfer deed) and mortgage deed.
We will ask you to send the agreed sum for exchange of contracts.
Once all parties are happy that all outstanding matters have been satisfied, we will exchange contracts which legally ties all parties to the agreement to complete once the property is finished.
Moving day! When the property is ready to be lived in and has been approved by the building regulations inspector, we’ll receive a notice from the developer confirming the completion date. We will then request your mortgage funds and confirm any balance due from you. Once completion has taken place, the home builder will call you to arrange collection of the keys to your brand new home!
How long should it take? Whilst timeframes can vary considerably due to various factors such as mortgage delays, chains, searches and obviously how long it takes the builder to finish construction, the average transaction time from the purchase being agreed to you moving in, according to the Homeowner’s Alliance, is almost 20 weeks. Thanks to our cutting-edge systems and superb staff, at Evolve Law we average around 6 weeks for a standard purchase from the contracts being received to exchange of contracts. How long it then takes for you to be able to move in is entirely down to the developer.
